L&#8217;auteur vise \u00e0 influencer les l\u00e9gislations et la pratique de la propri\u00e9t\u00e9 intellectuelle dans les pays africains\u00a0; le travail rappelle que la lutte de l\u2019Afrique du Sud contre des laboratoires occidentaux a permis d\u2019aboutir aux accords <strong><em>TRIPS \u00e0 Doha<\/em><\/strong>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">L\u2019article se d\u00e9marque n\u00e9anmoins des analyses qui mettent l\u2019accent sur l\u2019inad\u00e9quation des TRIPS face aux besoins sanitaires des pays en d\u00e9veloppement\u00a0; l\u2019auteur sugg\u00e8re aux africains une strat\u00e9gie de combat acceptant, au contraire,\u00a0 la structure des relations et des trait\u00e9s internationaux, dans le but d\u2019en infl\u00e9chir la pratique. A cette fin, l\u2019auteur souligne d\u2019abord l\u2019interpr\u00e9tation abusive que font les tribunaux am\u00e9ricains des droits de propri\u00e9t\u00e9 intellectuelle\u00a0; mais elle observe que la doctrine juridique US peut s\u2019appuyer sur la <strong><em>constitution am\u00e9ricaine<\/em><\/strong> (art. I, sect. 8, cl. 8) pour consid\u00e9rer qu\u2019une protection stricte de la propri\u00e9t\u00e9 intellectuelle contribue fortement au progr\u00e8s\u00a0; h\u00e9las, regrette l\u2019auteur, les am\u00e9ricains ont une f\u00e2cheuse tendance \u00e0 confondre progr\u00e8s et accumulation maximis\u00e9e de richesses\u00a0!<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Dans ces conditions, elle sugg\u00e8re aux organisations et pays africains d\u2019ins\u00e9rer dans leurs documents juridiques pertinents la d\u00e9claration d\u2019objectifs selon laquelle la propri\u00e9t\u00e9 intellectuelle, en Afrique, doit contribuer en priorit\u00e9 au <strong><em>d\u00e9veloppement humain<\/em><\/strong>. De proche en proche, une telle doctrine finira par b\u00e9n\u00e9ficier d\u2019un important \u00e9cho en mati\u00e8re internationale, sans lamentations. L\u2019auteur signale d\u2019ailleurs que les africains b\u00e9n\u00e9ficieraient en plus d\u2019instruments juridiques parfaitement coh\u00e9rents puisque\u00a0 <strong><em>la priorit\u00e9 au d\u00e9veloppement humain<\/em><\/strong> est d\u00e9j\u00e0 la doctrine retenue par l\u2019Union Africaine dans <strong><em>La Strat\u00e9gie de l\u2019Union Africaine pour la Science, la Technologie et l\u2019Innovation<\/em><\/strong>.
